RELEASE OF LIABILITY,
ASSUMPTION OF RISK, AND WAIVER OF CLAIMS
IMPORTANT NOTICE TO PURCHASERS: PLEASE READ CAREFULLY BEFORE AGREEING
By checking the box during checkout and completing your purchase, you (“Purchaser” or “User”) acknowledge and agree to the following Release of Liability and Assumption of Risk on behalf of yourself, your heirs, personal representatives, successors, and assigns.
This release applies to all products sold by Gyro Technic LLC, a Minnesota limited liability company, through this website or any associated platform.
1. NOTICE OF INHERENT RISKS IN AVIATION
You acknowledge and understand that aviation activities—particularly those involving experimental or homebuilt aircraft—are inherently dangerous and involve substantial risks, including but not limited to: mechanical failure, pilot error, component malfunction, mid-air collisions, ground impact, fire, property damage, serious bodily injury, and death.
Gyro Technic LLC designs and manufactures parts intended for use in experimental, non-certified aircraft. These products are not FAA-certified, and their use is entirely at the risk of the User.
2. ASSUMPTION OF RISK
By purchasing and using Gyro Technic LLC products, you voluntarily assume all risks associated with the installation, handling, modification, and use of these parts in any aviation or non-aviation setting.
You accept full responsibility for any loss, injury, or damage—whether to yourself, others, or property—that may result from the use or misuse of any product purchased from Gyro Technic LLC.
3. RELEASE OF LIABILITY AND WAIVER OF CLAIMS
To the fullest extent permitted by law, you hereby release, waive, and discharge Gyro Technic LLC, its owners, officers, employees, agents, suppliers, and affiliates from any and all claims, demands, liabilities, damages, or legal actions arising from or related to the use of any product sold by Gyro Technic LLC.
This waiver includes but is not limited to claims for:
- Negligence (except gross negligence or willful misconduct)
- Product liability
- Personal injury
- Property damage
- Death
4. INDEMNIFICATION
You agree to indemnify and hold harmless Gyro Technic LLC from any claims, lawsuits, losses, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your purchase, installation, use, or resale of any products.
5. NO WARRANTIES – PRODUCTS PROVIDED “AS IS”
Gyro Technic LLC makes no warranties or guarantees, express or implied, including any warranty of merchantability or fitness for a particular purpose. All products are sold “AS IS” and intended solely for use by experienced individuals who understand the associated risks.
6. COMPLIANCE WITH LAWS AND STANDARDS
It is solely your responsibility to ensure that any product purchased from Gyro Technic LLC is used in compliance with all applicable local, state, and federal laws and aviation regulations, including FAA requirements. Installation and use should be performed by qualified individuals.
7. GOVERNING LAW
This Release shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of laws principles.
BY CHECKING THE BOX, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT IN FULL, UNDERSTAND ITS TERMS, ACCEPT ALL RISKS, AND VOLUNTARILY AGREE TO BE LEGALLY BOUND BY IT.
